By accessing and using the Mass General Brigham Health Plan Provider Portal, you are agreeing to be legally bound by this User Agreement. As used herein, the term "you" means a User Administrator or other User accessing the Provider Portal.

Overview

The Provider Portal is Mass General Brigham Health Plan’s Web-based transaction service for providers. The Provider Portal capabilities include the ability to verify patient eligibility; view claim status and a patient’s personal health record (PHR)/Protected Health Information (PHI); create/view notification of specialty referrals/authorizations; view/download your electronic Explanation of Payment (remittance advice); and PCP assignment changes.

Conditions of Use

Mass General Brigham Health Plan may change any term in this User Agreement at any time. The changes will appear in this User Agreement, and your use of the Provider Portal after any changes have been posted will constitute your agreement to the modified User Agreement and all of the changes. Therefore, you should read this User Agreement each time you access the Provider Portal.

By accessing and using the Provider Portal, you are also agreeing to be legally bound by the Provider Portal Terms of Use. For more information, see the full Terms of Use.

You may not use the Provider Portal for any unlawful purpose or any purpose not approved by Mass General Brigham Health Plan.

THE PROVIDER PORTAL AND THE CONTENT AVAILABLE THROUGH THE PROVIDER PORTAL (THE “CONTENT”) ARE SUBJECT TO CHANGE AT ANY TIME. THE PROVIDER PORTAL AND THE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. MASS GENERAL BRIGHAM HEALTH PLAN AND ITS AFFILIATES, AGENTS AND LICENSORS CANNOT AND DO NOT MAKE ANY REPRESENTATION WITH RESPECT TO OR WARRANT THE ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, TITLE, NONINFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE OF THE CONTENT, OR THE PROVIDER PORTAL ITSELF, AND MASS GENERAL BRIGHAM HEALTH PLAN HEREBY DISCLAIMS ANY SUCH EXPRESS OR IMPLIED WARRANTIES. Roles and Responsibilities

User Administrators and Users

Mass General Brigham Health Plan requires each organization using the Provider Portal to designate a user administrator (“ User Administrator ”). A “User” is an individual who has been granted access to the Provider Portal by their User Administrator. A User Administrator may also be a User.

If you are a User Administrator, you are responsible for the administration of all Provider Portal User accounts within your organization and for ensuring that these Users adhere to the terms of this User Agreement and the Provider Portal Terms of Use. In addition, you are responsible for maintaining your organization’s User list and modifying your organization’s User accounts as needed, as set forth in more detail below.

An organization may not have more than two User Administrators. Organizations with two User Administrators must ensure that these staff members work together to manage their Users’ access within the Provider Portal to ensure compliance with this User Agreement and the Provider Portal Terms of Use.

User Administrator Responsibilities

If you are a User Administrator, you have the authority and responsibility to:

• Add new Uses;
• Modify existing Users; and
• Delete Users no longer active in your organization or as required by Mass General Brigham Health Plan;
• Ensure that all Users within your organization are aware of and are adhering to the most current version of this User Agreement and the Provider Portal Terms of Use;
• Ensure that each User has a unique ID and password;
• Ensure that User login IDs and passwords are not shared among your organization’s staff;
• Ensure that User login IDs and passwords are kept confidential, are not shared among your organization’s staff, and are not disclosed to any other party;
• When a User’s employment is terminated, ensure that the User’s account is deleted immediately as of the effective date of termination;
• Maintain an up-to-date list of your organization’s Users and conduct a monthly account revalidation of the current User list to ensure that Users are added and deleted as appropriate;
• Immediately notify Mass General Brigham Health Plan of any unauthorized use of a User’s login ID or password or any other breach of security.

User Responsibilities

If you are a User, you must comply with the following terms and conditions, in addition to the other provisions of this User Agreement and the Provider Portal Terms of Use:

For security reasons, you must not disclose your password information to any party. You are responsible for maintaining the confidentiality of your login ID and password.
You agree to immediately notify your User Administrator of any unauthorized use of your login ID or password or any other breach of security.
You agree to ensure that you properly exit from your account at the end of each Provider Portal session.
You are responsible for all activity or transactions accessed or conducted through the Provider Portal that is attributable to your login ID and password.
You will use your best efforts to ensure that any data, text or information, including without limitation, enrollment, payment, claims adjudication, case or medical management, medical or billing record information and any Personal Information (as defined in 201 CMR 17.00) or Protected Health Information (as defined in 45 C.F.R. § 164.501) that you access or retrieve through or from the Provider Portal will be (a) used solely in furtherance of the relationship that you and/or the provider for whom you are an authorized representative has with Mass General Brigham Health Plan, and (b) maintained in confidence and not disclosed to any other party, except to other staff members within your organization who have a need to know such information in connection with your organization’s relationship with Mass General Brigham Health Plan.
You understand that all information, data, text, and other materials (“Information”) are the sole responsibility of the person from whom such Information originated. This means that you, and not Mass General Brigham Health Plan, are entirely responsible for all Information that you upload, e-mail, transmit, or otherwise make available via the Provider Portal. You hereby grant Mass General Brigham Health Plan and all other persons and entities involved in the operation of the Provider Portal the right to transmit, monitor, retrieve, store and use in connection with the operation of the Provider Portal all Information that you upload, e-mail, transmit, or otherwise make available via the Provider Portal.
You agree that you will not use any device, software, or routine to interfere or attempt to interfere with the proper working of the Provider Portal or any activities conducted on the Provider Portal.
You agree that Mass General Brigham Health Plan, in its sole discretion, may terminate your login ID and password, and your access to the Provider Portal, and remove and discard any Information that you have uploaded, e-mailed, transmitted, or otherwise made available via the Provider Portal, if Mass General Brigham Health Plan believes that you have violated this User Agreement or the Provider Portal Terms of Use. You agree that Mass General Brigham Health Plan shall not be liable to you or any third party for any termination of your access to the Provider Portal.

General

Mass General Brigham Health Plan cannot and will not be liable for any loss or damage arising from the failure of any User Administrator or User to comply with the terms of this User Agreement.
